Terms & Conditions

Last Updated: October 18, 2026

These Terms and Conditions (“Terms”) govern your use of the Marriages By Proxy LLC website and your purchase or use of services offered by Marriages By Proxy LLC (“Marriages By Proxy,” “MBP,” “we,” “us,” or “our”). By accessing our website, submitting information to us, purchasing services, or otherwise using our services, you agree to these Terms.

Please read these Terms carefully before purchasing or using our services.

1. Our Services

Marriages By Proxy LLC provides administrative and coordination services intended to assist eligible couples with the Montana proxy-marriage process. Depending upon the service purchased, our services may include assisting with forms and documents, coordinating signatures and notarizations, communicating with government offices and other third parties, arranging for a proxy representative, coordinating solemnization, submitting or facilitating submission of marriage documents, and obtaining or arranging for certified copies of marriage records.

The particular services included in your purchase are those identified in the package, order confirmation, invoice, or other written description provided to you.

We may use employees, independent contractors, couriers, notaries, officiants, proxy representatives, government offices, and other third parties in providing these services.

2. Eligibility for a Montana Proxy Marriage

Montana law establishes specific requirements for marriage by proxy. You are responsible for providing complete and accurate information and ensuring both parties satisfy those requirements.

Acceptance of an order or payment does not constitute a guarantee that you are legally eligible to marry or that a marriage license will be issued.

Government officials, including the appropriate Clerk of District Court, retain authority over the issuance and processing of marriage licenses and marriage records.

If we determine that either party does not satisfy the requirements applicable to the service requested, or if a government office declines to issue or process the necessary documents, we may decline or discontinue the service.

3. Client Representations

By purchasing or using our services, each party represents and warrants that:

  • all information and documents provided are true, accurate, current, and complete;

  • each party is legally competent to enter into the marriage;

  • each party is entering the marriage knowingly and voluntarily and without pressure or coercion from anyone;

  • each party has freely consented to the marriage;

  • neither party is currently married to another person;

  • the proposed marriage is not otherwise prohibited by applicable law;

  • all identification and supporting documents provided are authentic and have not been altered or falsified;

  • the parties have disclosed any circumstance that could materially affect their eligibility to marry; and

  • the marriage is not being undertaken for an unlawful or fraudulent purpose.

You agree to promptly notify us if any information you have provided changes before completion of the marriage.

We may refuse or discontinue services if we suspect any information or documentation is false, incomplete, inconsistent, fraudulent, or otherwise insufficient to proceed.

4. Accuracy of Information

You are responsible for carefully reviewing all names, dates, addresses, identification information, prior-marriage information, and other information submitted to us or appearing on documents prepared in connection with your marriage.

Marriages By Proxy is not responsible for delays, additional expenses, rejected documents, or other consequences resulting from inaccurate, incomplete, or misleading information supplied by either party to the marriage.

5. No Guarantee of Processing Time

Any estimated completion, processing, filing, or delivery time is an estimate only and is not guaranteed. Processing times may be affected by government office schedules, staffing, holidays, mail or courier delays, notarization requirements, incomplete documentation, requests for additional information, technical problems, severe weather, or circumstances outside our control.

6. Government Agencies and Third Parties

Marriages By Proxy is a private company. We are not a government agency and are not affiliated with or endorsed by the State of Montana, any Montana county, the United States military, the Department of Defense, the Department of State, U.S. Citizenship and Immigration Services, or any other governmental entity unless expressly stated otherwise.

Marriage licenses, certificates, certified copies, and other official records are issued, accepted, filed, or maintained by the applicable governmental authorities.

We cannot control the actions, policies, processing times, or decisions of government agencies or third-party service providers and are not responsible for delays or denials caused by those entities.

7. Recognition Outside Montana

A marriage validly entered into under Montana law may have legal consequences outside Montana. However, laws, administrative policies, and recognition requirements vary by jurisdiction and may change so consult an attorney with any legal questions concerning your particular circumstances.

Marriages By Proxy does not guarantee that a Montana proxy marriage will be accepted for every purpose by every state, country, government agency, military authority, employer, insurer, financial institution, immigration authority, or other organization. Consult an attorney concerning your particular circumstances.

Before relying upon a proxy marriage for a particular legal, governmental, immigration, military, financial, or international purpose, you are responsible for determining whether the relevant jurisdiction or organization will recognize or accept the marriage for that purpose.

8. Immigration and Citizenship Matters

Marriages By Proxy does not guarantee that a proxy marriage will satisfy the requirements of U.S. immigration law or the immigration laws of any foreign country.

If your marriage is intended for immigration, citizenship, visa, residency, or similar purposes, you should obtain advice from a qualified immigration attorney concerning your particular circumstances.

9. Military Benefits

A marriage performed through our services does not guarantee eligibility for military benefits, allowances, enrollment programs, dependent status, housing, health insurance, immigration benefits, or any other government benefit.

Eligibility for military and government benefits is determined by the applicable agency or authority under its own laws, regulations, and procedures.

You are responsible for determining what documentation will be required for your particular purpose.

10. No Legal Services or Attorney-Client Relationship

Marriages By Proxy LLC provides administrative and coordination services and does not provide legal advice to either party through the proxy-marriage services offered on this website. There is no attorney-client relationship created through the use of the website or Marriages By Proxy LLC.

Information provided by Marriages By Proxy LLC through its ordinary services is general information and should not be understood as individualized legal advice.

If circumstances arise requiring legal advice concerning marriage validity, immigration, recognition in another jurisdiction, family law, estate planning, taxes, military benefits, or another legal issue, please consult an attorney of your choosing.

11. Fees

You agree to pay the fees stated at the time you purchase our services.

Unless expressly stated otherwise, our service fee does not include expenses that may be imposed by government agencies or third parties, including apostille or authentication fees, expedited shipping, international shipping, translation expenses, additional notarizations, or other third-party charges.

Any additional charge requiring your payment will be disclosed before we incur that charge on your behalf unless you have previously authorized the expense.

12. Cancellations and Refunds

We understand that circumstances may change. Because Marriages By Proxy LLC begins performing services and may incur expenses on your behalf shortly after an order is placed, the amount of any refund depends upon the stage your order has reached when we receive your cancellation request.

Before Work Begins - 100% Refund

If you cancel your order before Marriages By Proxy has begun performing services on your behalf, you will receive a 100% refund of amounts paid to Marriages By Proxy, less any lawfully deductible, previously disclosed payment-processing charges.

After Document Preparation Begins - 75% Refund

Once Marriages By Proxy has begun preparing, reviewing, completing, assembling, or processing documents specifically for Clients' marriage, cancellation is eligible for a refund equal to 75% of the amount paid to MBP, less any lawfully deductible, previously disclosed payment-processing charges.

For purposes of this provision, document preparation begins when MBP first performs substantive work on Clients' marriage documents following receipt of their completed marriage application.

Payment, booking, and submission of the marriage application do not, by themselves, constitute the commencement of document preparation.

After Government, Proxy, Officiant, or Notary Costs Are Incurred - 50% Refund

Once Marriages By Proxy has incurred or committed to costs associated with a government agency, proxy representative, officiant, notary, or similar third party in connection with your marriage, cancellation is eligible for a refund equal to 50% of the amount paid to Marriages By Proxy, less any lawfully deductible, previously disclosed payment-processing charges.

For purposes of this provision, a cost is considered “incurred” when Marriages By Proxy has paid the cost or has become obligated to pay the cost, regardless of whether the third party has completed the applicable service.

After Solemnization - No Refund

Once the marriage has been solemnized, all fees are nonrefundable.

For purposes of this policy, solemnization occurs when the marriage ceremony or other act constituting solemnization under applicable Montana law has been completed, regardless of whether the marriage certificate has subsequently been filed, recorded, or returned to the parties.

Client-Caused Inability to Complete Services

Notwithstanding the refund schedule above, Marriages By Proxy is not required to provide a refund if services cannot be completed because a client:

  • provided false, fraudulent, or materially inaccurate information or documentation;

  • failed to disclose information materially affecting eligibility to marry;

  • failed to provide required documents, signatures, identification, notarizations, or other information within a reasonable time;

  • became legally ineligible to marry;

  • attempted to use our services for an unlawful or fraudulent purpose; or

  • otherwise materially breached these Terms.

Nothing in this provision limits any refund or other consumer right that cannot lawfully be waived.

How to Cancel

Cancellation requests must be submitted to info@marriagesbyproxy.com

The applicable refund percentage will be determined by the stage of service reached at the time Marriages By Proxy receives the cancellation request.

Approved refunds will be issued to the original payment method whenever reasonably practicable. Processing times imposed by banks, credit-card companies, payment processors, or other financial institutions are outside our control.

13. Chargebacks and Payment Disputes

If you believe a charge is incorrect or that we have failed to provide a purchased service, please contact us so that we have an opportunity to investigate and resolve the issue.

Initiating a chargeback does not relieve you of responsibility for legitimate charges for services actually performed or expenses incurred on your behalf.

We reserve the right to provide payment processors and financial institutions with documentation reasonably necessary to respond to a payment dispute or chargeback.

14. Client Cooperation

Timely completion of our services depends upon your cooperation.

17. Fraud and Unlawful Activity

Our services may not be used to facilitate fraud, sham marriages, immigration fraud, bigamy, identity theft, coercion, human trafficking, evasion of legal restrictions, or any other unlawful purpose.

We reserve the right to refuse, suspend, or terminate services if we suspect fraud, coercion, unlawful activity, falsified documentation, identity concerns, or material misrepresentations.

To the fullest extent permitted by applicable law, our aggregate liability arising from or relating to the services provided to you will not exceed the amount of service fees actually paid by you to Marriages By Proxy for the particular service giving rise to the claim.

These limitations do not apply to liability that cannot lawfully be limited or excluded.

22. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Marriages By Proxy LLC and its members, managers, employees, contractors, and agents from claims, losses, liabilities, damages, and reasonable expenses arising from your material misrepresentation, fraudulent or unlawful conduct, falsified documentation, or material breach of these Terms.

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

If a separately signed written agreement expressly conflicts with these Terms, the separately signed agreement controls to the extent of that conflict.

29. Changes to These Terms

We may revise these Terms from time to time. The version applicable to a particular purchase will ordinarily be the version in effect when the purchase was made, unless applicable law requires otherwise or you agree to amended terms.
